1. Warranty Coverage
PlatoScience ApS (the "Company") provides a limited warranty to the original end-user purchaser (the "Customer") of the PlatoWork 2.0 tDCS Neurostimulation Device (the "Device").
This warranty covers the Device against manufacturing defects in materials and workmanship under normal use as specified in the most recent official PlatoWork 2.0 Instructions for Use (the "IFU").
2. Warranty Period
The warranty period begins on the date the Customer purchases the Device from the authorized Device provider (the "Purchase Date"). The warranty shall expire:
2.1 Two (2) years from the Purchase Date.
The Customer must provide valid proof of purchase, including the Purchase Date, when making a warranty claim.
3. Conditions of Intended Use
The Device is for personal use by a single individual (the Customer), limited to once per day. Using the Device outside the scope of the IFU may void your warranty.
This Limited Warranty is immediately void if the Device is, or is reasonably suspected of having been, used in any of the following prohibited ways:
3.1 Multi-User Application: Used by multiple individuals, whether in a home or a professional/clinical setting.
3.2 Excessive Frequency: Used with a frequency exceeding the intended personal use rate (i.e., multiple sessions per day).
In assessing warranty claims, PlatoScience ApS reserves the right to examine the Device's usage data logs to determine if usage history indicates multi-user or excessive daily application.
Coverage under this Limited Warranty is restricted to countries where PlatoScience officially supplies the Product. The warranty does not extend to use outside of these authorized regions.
4. Warranty Remedy
If a defect covered by this Limited Warranty arises during the Warranty Period, and the Company validates the claim, the Company will, at its sole discretion, provide the following remedy:
4.1 Product Replacement: The defective Device will be replaced with a new PlatoWork 2.0 or equivalent Device.
5. Exclusions
This Limited Warranty does not cover any of the following:
5.1 Normal Wear and Tear: Including, but not limited to, cosmetic damage, scratches, dents, or degradation of accessories due to normal use.
5.2 Accidental Damage: Damage resulting from accidents, drops, spills, liquid exposure, or fire.
5.3 Salt water damage : if it is clear that salt water has been applied elsewhere than electrode surfaces (for example on the headset frame, which will result in damage to the device electronics).
5.4 Misuse or Abuse: Damage resulting from use outside the scope of the intended use, intentional abuse, or failure to follow the IFU. This includes use outside the intended specifications of the device.
5.5 Unauthorized Modification or Repair: Damage caused by service (including upgrades and expansions) performed by anyone who is not an official representative of PlatoScience ApS.
5.6 External Causes: Damage caused by external factors such as power surges or natural disasters.
5.7 Devices where the serial number has been removed, defaced, or altered.
6. How to Make a Claim
To initiate a warranty claim, the Customer must:
6.1 Contact the Device provider (point of purchase) within the Warranty Period, and provide:
6.1.1 The Device's serial number and a detailed description of the defect.
6.1.2 Valid proof of purchase (e.g., receipt or invoice) clearly showing the Purchase Date.
6.2 If requested, return the Device to PlatoScience ApS in accordance with the Company’s instructions.
7. Limitation of Liability
To the maximum extent permitted by applicable law, the remedies set forth above are the Customer's sole and exclusive remedies and PlatoScience ApS’s entire liability for any breach of this Limited Warranty. PlatoScience ApS shall not be liable for any incidental, indirect, special, or consequential damages, including loss of profits, arising from the use of the Device.
